U.S. Immigration Wait Times 2022

You can check the specific listed processing times on the USCIS website https://egov.uscis.gov/processing-times/. Those time frames are only useful for knowing when you can file an inquiry or status request though. USCIS rarely actually follows those posted processing times.

 

IMPORTANT ALERT

EXTREME DELAYS IN THE PROCESSING OF FORM I-765,

EMPLOYMENT AUTHORIZATION DOCUMENT

(EAD Card or Work Card as well as SSN)

Processing TIME: 12-16 MONTHS

There are EXTREME DELAYS & BACKLOGS IN THE PROCESSING OF I-765 EMPLOYMENT AUTHORIZATION APPLICATIONS.

Most Applicants for Adjustment of Status are receiving their green card before their EAD card. Those who get an EAD card usually get it about 3-4 weeks before their green card interview.

Employment authorization and Advance Parole Travel no longer exist essentially. I have had multiple people put off applying, and one person actually elect to intentionally depart the U.S. and trip the ten-year bar on reentry because they can't go a year without being able to legally work, have a social security number, get ID, or travel abroad just because USCIS is choosing not to issue EAD cards in a reasonable time frame anymore.

They claim their is a backlog in card production causing this but that is simply not true. The card is printed in 1-2 days. Usually the day a green card is put into production it also ships, if not it always ships within 1-2 days of being ordered. When EAD card is put into production or requested after a successful expedited request, it takes 4 days.

There is no time ever when the production of a card takes 10-12 months and that claim doesn't make sense.

The Biden Administration is keeping many of the Trump Administration's tactics used to limit abuse of U.S. immigration benefits, and also reduce legal immigration benefits but making them more difficult to obtain. If someone is in the U.S. without legal status but they have the ability to legally obtain a green card (through marriage to a US citizen for instance), they used to get their employment authorization within months of filing. So 90 days after violating a visitor visa they could have legal authority to work, a SSN, a drivers license, even travel abroad as much as they want. Essentially they would live in the U.S. no differently than anyone else until they get the green card.

Now, in Biden's America, a person who has a legal path to a green card won't be able to work, get an ID, travel abroad, get a SSN, or have any proof of status for OVER A YEAR while they wait for the green card.

A green card applicant who doesn't have a savings account with  a year's salary in it to cover their living expenses while they wait with no ability to drive, work, get an ID, open  bank accounts, visit family abroad, or do business abroad. They are forced to either work illegally or give up and leave the U.S. 

 

The Biden administration is again, setting immigration policy to reduce access to the poor or even middle class. The current processing times make it so that only the wealthy can afford to immigrate to the U.S. legally.

Further, without those documents they can't do things like open bank accounts, file taxes, work, drive, be added to their spouse's insurance documents, etc. This means that it's even harder for them to get their green card because the above-listed documents are all asked for at the green card interview.

The delays in processing EAD's is affecting the outcome of green card applications because USCIS is asking immigrants to to provide documents they cannot obtain without employment authorization but USCIS hasn't issued that authorization yet!.

I-485 Application for Adjustment of Status (Green Card)

11-16 Months

Most marriage based I-130/I-485 Applications are processed in about 12-14 months but are scheduled for an interview in as little as 7-8 months if they are in less busy locations.

N-400 Application for Naturalization (Citizenship)

13 - 19 MONTHS

Most N-400 applications are scheduled within about a year but in some cases they are taking a little longer. At less busy field office locations they are a bit quicker. Holtsville NY, despite being a fairly small and usually not a very busy office, has had been taking longer than average in 2022.  Newark, NJ is the busiest N-400 location in the U.S. right now and they are even starting to send some of their N-400 cases to NY!

I-90 Replacement Green Card or Renewal

6-14.5 Months

Form I-90, Applications to Replace lost/stolen green card or renew expiring green card is taking an extremely long time due to extensive backlogs at USCIS.

It is literally taking over a year for most people to get a replacement card or a new card after filing an I-90 renewal, even if filed as earlier as legally allowed before the previous card expires.

Expect new green card to take a year or longer.

I-90 replacement or renewal processing times are 12-16 months in my experience thus far in 2022.

By far the most common question about processing times / wait time.

HOW LONG DOES IT TAKE TO GET SOCIAL SECURITY NUMBER (SS# or SSN) & EMPLOYMENT AUTHORIZATION (EAD)?

You should not expect to receive your employment authorization card (EAD) and social security number until at least 8-9 months after filing. Often times taking up to a year for an I-765 filed concurrently with an Adjustment of Status package.

Since July of 2021, most of my clients have been getting their employment authorization (and Advance Parole Document) 2-3 weeks before their I-485 Green Card Interview, if they get it. About 20% of recent clients received their physical green card before their employment authorization was approved.

HOW LONG DOES IT TAKE TO GET AN ADVANCE PAROLE TRAVEL DOCUMENT AFTER FILING MY APPLICATION?

It will most likely take a year or longer and may take up to two years if you are just filing now.

You can expedite your request and USCIS issues an emergency travel document, which is extremely difficult to get.
