Representation for Minors/Juveniles to Obtain Legal Status in the US

We represent children in removal proceedings, unaccompanied minors stopped at the border, and minor children who are in the US without immigration status in applying for Special Immigrant Juvenile Status (or SIJS). 

Special Immigrant Juvenile Status (SIJS) is a process by which eligible children in the US are able to gain legal permanent resident status or get a green card. Children or are eligible may apply for SIJS affirmatively or they may seek SIJS as a form of relief if they are stopped at the border or put into removal / deportation proceedings in Immigration Court.

Who is Eligible for Special Immigrant Juvenile Status (SIJS)?

To be eligible for SIJ status:

  • You must be under 21 years old on the filing date of the Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant

  • Your state court order must be in effect on the filing date of the Form I-360 and when USCIS makes a decision on your application, unless you “aged out” of the state court’s jurisdiction due to no fault of your own

  • You cannot be married, both when you file your application and when USCIS makes a decision on your application

    • “Not married” includes a child whose marriage ended because of:

      • Annulment

      • Divorce

      • Death

  • You must be inside the United States at the time of filing the Form I-360
